In these Terms, “Aberdeen Collectables”, “we”, “us” and “our” refer to ABERDEEN COLLECTABLES LTD.

Our store is hosted by Shopify. Shopify provides the ecommerce platform, but any purchase you make is a contract directly between you and Aberdeen Collectables.

2. These Terms

These Terms apply when you access our website, create a customer account or purchase products from us.

Our Privacy Policy, Shipping Policy and Return and Refund Policy also apply and are available through the footer of our website.

Nothing in these Terms excludes or limits your statutory rights as a consumer.

3. Customer accounts and information

You may be able to purchase products as a guest or through a customer account.

You must provide accurate, current and complete contact, billing and delivery information. You are responsible for checking that your delivery address is correct before submitting an order.

You are responsible for activity carried out through your customer account and for maintaining access to the email address connected to it.

If you are under 18, you should only use the website or place an order with the involvement and permission of a parent or guardian.

4. Products and descriptions

We take reasonable care to describe products accurately and provide clear photographs where appropriate.

Colours, foil effects and product appearance may differ slightly depending on lighting, photography, screen settings and the device being used.

Raw trading cards

Condition descriptions for ungraded cards represent our honest assessment based on the card’s visible condition. Condition terminology can be subjective and does not guarantee that a card will receive a particular grade from a professional grading company.

Where a listing states that photographs show the exact card, the customer will receive the photographed card.

Graded cards

Grades, labels and certification numbers are issued by the grading company named in the product listing. Aberdeen Collectables is not responsible for the grading company’s grading standards, opinions or future changes to its certification records.

The purchase of a graded card does not guarantee its future value or resale price.

Sealed products and booster packs

Unless expressly stated otherwise, sealed products are sold with manufacturer-applied packaging.

The contents of booster packs, booster boxes and other randomly assorted products are determined by the manufacturer. No particular card, rarity, pull rate or financial value is guaranteed.

Minor manufacturing marks or small variations that are normal for mass-produced packaging will not necessarily amount to a fault. Any significant damage known to us will be disclosed in the product description.

Trademarks

Pokémon, One Piece and other product names, logos and trademarks belong to their respective owners. Aberdeen Collectables is an independent retailer and is not affiliated with or endorsed by those rights holders unless expressly stated.

5. Prices and payment

Prices are shown in pounds sterling.

Aberdeen Collectables is not currently registered for VAT. VAT is therefore not added separately at checkout, and we do not issue VAT invoices.

Delivery charges are shown separately before you submit your order.

Payment must be made using one of the payment methods displayed at checkout. You confirm that you are authorised to use the payment method supplied.

Promotional prices and discount codes may be subject to additional conditions and may be withdrawn or changed before an order is placed.

6. Orders and acceptance

Submitting an order constitutes an offer to purchase the products in your basket.

An automated order confirmation acknowledges that we have received your order but does not necessarily mean that we have accepted it. A contract is formed when we send confirmation that the order has been dispatched.

We may reject or cancel an order before dispatch where:

  • the product is unavailable;
  • payment cannot be authorised;
  • the delivery information is incomplete or invalid;
  • fraud or unauthorised activity is reasonably suspected;
  • the order breaches a purchase limit;
  • the product or price contains an obvious error; or
  • fulfilling the order would be unlawful.

Where payment has already been taken and we reject or cancel the order, we will issue a refund to the original payment method.

We may limit the quantity of products available to an individual customer where reasonably necessary to protect availability or prevent misuse.

7. Pricing and listing errors

We take reasonable care to ensure prices, stock information and descriptions are accurate.

If we identify an obvious pricing or listing error before accepting an order, we may contact you to offer the product at the correct price or cancel the affected item and issue a refund.

We will not substitute a materially different product without your agreement.

8. Pre-orders

Products advertised as pre-orders are subject to any specific information shown on the product page.

Release dates are estimates supplied by manufacturers or distributors and can change. We will provide updated information where a significant delay becomes known to us.

Placing a pre-order does not guarantee that the manufacturer or distributor will supply the full quantity originally expected. If we cannot fulfil a pre-order, the affected amount will be refunded.

Your statutory cancellation rights are not affected.

9. Shipping and delivery

We currently deliver only to addresses within the United Kingdom.

Available delivery methods, charges and estimated timescales are displayed at checkout and explained in our Shipping Policy.

Delivery estimates are not guaranteed dates. Events outside our reasonable control, including carrier disruption, severe weather and industrial action, may cause delays.

Unless another timeframe has been agreed, orders will be delivered without undue delay and no later than 30 days after the contract is formed.

You must contact us promptly if tracking shows a parcel as delivered but it has not been received, or if an order arrives damaged.

Products remain at our risk until they are physically delivered to you or to another person you have nominated to receive them. The exception is where you independently commission a carrier that we did not offer as a delivery option.

10. Cancellations and change-of-mind returns

Your cancellation and return rights are described fully in our Return and Refund Policy.

For most products purchased online, you may notify us that you wish to cancel within 14 days after the order is delivered. After notifying us, you normally have a further 14 days to return the goods.

For change-of-mind returns:

  • you are normally responsible for arranging and paying for return shipping;
  • goods must be returned securely and with reasonable care;
  • we may reduce the refund where handling beyond what would reasonably be permitted in a shop has diminished the product’s value; and
  • any enhanced or express delivery charge above the cost of our standard delivery method does not have to be refunded.

Opening booster packs, removing factory shrink-wrap or breaking tamper seals on collectable products can substantially reduce their value. Where permitted by law, this may result in a deduction reflecting the reduction in value. It does not affect your rights where the product was faulty, damaged or misdescribed.

11. Faulty, damaged or misdescribed products

Products must be of satisfactory quality, fit for their normal purpose and match their description.

Contact us promptly if a product:

  • is faulty;
  • was damaged before or during delivery;
  • is not the product ordered;
  • materially differs from its description; or
  • is suspected to be counterfeit.

Where the product does not conform to the contract, we will provide the remedy required by applicable consumer law. This may include a refund, repair or replacement depending on the circumstances.

We will bear reasonable return costs where goods are faulty, damaged, incorrect or misdescribed.

Nothing in these Terms or our Return and Refund Policy removes your statutory consumer rights.

12. Intellectual property

The Aberdeen Collectables name, original logo, website design, photographs, graphics and written content are owned by us or used with permission.

You may view and use the website for personal, non-commercial purposes. You must not reproduce, republish, sell, scrape or commercially exploit our original content without permission.

Product names, artwork and trademarks owned by third parties remain the property of their respective owners.

13. Reviews and customer content

Where you submit a review, photograph or other content, you confirm that:

  • it is truthful and based on your genuine experience;
  • you have the right to submit it;
  • it does not infringe another person’s rights;
  • it does not contain unlawful, abusive or misleading material; and
  • it does not contain malicious software or unsolicited advertising.

You grant us a non-exclusive, royalty-free licence to display and reproduce that content for operating and promoting Aberdeen Collectables.

We may remove content that breaches these Terms or applicable law.

14. Prohibited use

You must not use the website:

  • for unlawful or fraudulent activity;
  • to interfere with the website’s operation or security;
  • to introduce malware or harmful code;
  • to obtain unauthorised access to accounts or information;
  • to collect other customers’ personal information;
  • to impersonate another person;
  • to submit false payment or delivery details;
  • to infringe intellectual-property rights; or
  • to carry out abusive, threatening or discriminatory conduct.

We may restrict access to the website or suspend an account where we reasonably believe these requirements have been breached.

15. Third-party services and links

The website may include payment services, delivery tracking, applications or links operated by third parties.

Third-party services may have their own terms and privacy policies. We are not responsible for content on independent third-party websites that we do not control.

Shopify provides the technical platform used by our store but is not the seller of products purchased from Aberdeen Collectables.

16. Privacy

We process personal information in accordance with our Privacy Policy.

Information may be processed by Shopify, payment providers, delivery companies and other service providers where necessary to operate the store, process payments and fulfil orders.

17. Website availability

We do not guarantee that the website will always be available without interruption or technical error.

We may temporarily suspend or change parts of the website for maintenance, security, operational or legal reasons.

This does not affect contracts for orders we have already accepted.

18. Our liability

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • defective products where liability cannot legally be excluded;
  • breach of your statutory consumer rights; or
  • any other liability that cannot legally be excluded.

We are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

The website and products are intended primarily for consumer use. We are not responsible for business losses, including loss of profit, revenue, opportunity or business interruption, arising from use of products for commercial purposes.

19. Severability and waiver

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

A delay in enforcing a right does not mean that the right has been waived.

20. Governing law and disputes

These Terms are governed by the laws of England and Wales.

If you live in Scotland, Northern Ireland or another part of the United Kingdom, you retain any mandatory consumer protections that apply where you live and may bring proceedings in the courts available to you under applicable law.

We encourage customers to contact us first so that complaints can be investigated and, where possible, resolved directly.

21. Changes to these Terms

We may update these Terms when our services, policies or legal obligations change.

The version applying to an order will normally be the version in force when that order was placed. Changes will not retrospectively remove rights relating to an existing order.

The latest version and its effective date will be displayed on this page.
